Gautam Gambhir Gets Interim Relief By High Court

The Delhi High Court has granted interim relief to former cricketer and Head Coach of Indian Cricket Team Gautam Gambhir, who is accused of fraud related to a real estate project. The case against Gambhir, the head coach of the Indian cricket team, is based on charges of cheating several homebuyers along with in connivance with various real estate firms. The case dates back to 2011.

On Monday, Justice Manoj Kumar Ohri of the Delhi High Court issued an interim order that would put a hold on the proceeding against Gambhir in the fraud case. This follows a petition he filed in order to set aside a ruling by the sessions court overturning a decision by a judicial magistrate acquitting him in the case.

The case involves alleged fraud against homebuyers and three real estate companies, namely Rudra Buildwell Reality Private Limited, HR Infracity Private Limited, and UM Architectures and Contractors Limited. Gambhir was a director and brand ambassador for the joint venture formed by these companies.

The Delhi-based buyers of the venture claimed that they had not been able to see even a little progress, and so, when they heard that there were various legal cases against the enterprise, they immediately filed a case against the companies, accusing them of cheating them.

Court’s Ruling

The Delhi High Court, in its interim order, gave relief to Gambhir by staying the proceedings initiated against him. The court also ordered Delhi Police to respond to Gambhir’s petition. The matter has been kept for further hearing on January 31, 2025. Till then, the order passed by the sessions court shall remain stayed, Justice Ohri said.

He also hinted that a detailed order would be issued later. Senior advocates Mukul Rohatgi and Paritosh Buddhiraja argued for Gambhir in the case.

The sessions court had earlier termed the order passed by the magistrate discharging Gambhir with the observation that the court had not exercised its discretion properly in assessing the charges brought against it.
