The BCCI will now look after the functioning and management of the Jammu and Kashmir Cricket Association. The High Court has terminated the services of the Administrator (CAA) and the Chief Executive Officer appointed by the court. A division bench of Justices Ali Mohammad Magare and Justice Punit Gupta of the High Court said that the BCCI will have to conduct elections at the earliest as per the recommendations of the Lodha Committee, discussing with all stakeholders, the parties who have filed the petitions. All this responsibility will remain with the BCCI till the elections are held.
The bench said that the memorandum of association prepared by the CAA and the role of the Chief Executive Officer regarding Rules and Regulation is satisfactory. Now the BCCI has to execute these. In this entire process, the BCCI will have to discuss with the former club members of the JKCA and the District Cricket Association members constituted by the CAA.
Keeping in mind the recommendations of the Lodha Committee, elections will have to be held as soon as possible under the rules. Till then the system will be looked after by the BCCI temporarily, as it is the jurisdiction of the BCCI itself. The BCCI may, if required, add the necessary provisions to the JKCA constitution under the prescribed rules.
The court said that the sports talents of Jammu and Kashmir and Ladakh should not be made to wait under any circumstances. Immediate activities and every effort should be made to bring the talents of both states to the national and international level in cricket. For this, there is no need to wait for any kind of audit report. The court said that cricket is not a normal sport in India. It is like a national sport, in which the emotions of the people are connected. It connects the whole country in many ways.
